You Have to Qualify
To qualify for a tax deduction on a per diem basis, you must first meet the requirements established by the IRS. In general, you must be a transportation worker whose job requires that you be away from home on a regular basis. Furthermore, you must be away from home longer than the hours in a normal day's work. If you start and end their day where you live, you are not generally eligible for a per diem deduction.
